Key No. 18-2023-0701 <br />Commonly known as 201 Sadie. <br />APPROVAL OF PRESENTATION OF OBSOLETE CITY -OWNED PROPERTY <br />In a letter to the Board, Police Chief Larry E. Bennett stated that Corporal Paul R. Deguch was in <br />good standing with the South Bend Police Department effective August 24, 1997 when he was killed <br />in the line of duty. In keeping with the spirit of Section 2-120 of the Municipal Code of the City of <br />South Bend, Indiana, it was requested that the Board of Public Works declare his service weapon, <br />a Sig Sauer .40 caliber handgun, (AD 19080 - the firing pin and magazine are not part of weapon as <br />presented) as surplus property no longer useful to the City. The presentation of the above described <br />property will be presented to Mrs. Deguch as a tribute for her husband's dedicated service to the City. <br />Upon a motion made by Mr. Littrell, seconded by Ms. Roemer and carried, the request was approved. <br />APPROVAL OF GRANT OF EASEMENT - MIAMI STREET SANITARY SEWER <br />Upon a motion made by Mr. Littrell, seconded by Ms. Roemer and carried, a Grant of Easement for <br />6115 Miami Road was approved. This Grant of Easement is in conjunction with the Miami Road <br />Sanitary Sewer project. <br />APPROVAL OF RELEASE OF EASEMENT - MERRY AVENUE <br />Mr. Carl Littrell, City Engineer, stated that Batteast Construction Company is in process of <br />redeveloping land in Arnold's First Addition to the City of South Bend. Their property includes Lots <br />1 to 5, 29 to 34 and 35-39 of that subdivision, including the vacated street and alleys adjacent to <br />those lots. There are not active sewer or water mains located in those vacated rights of way and there <br />is no need to retain right of easement for utilities in those vacated rights of way. Batteast <br />Construction Company requests that the rights of easement be released. Mr. Littrell recommended <br />that the Board release all rights of easement for utilities in the following locations: <br />a. In vacated Merry Avenue south of lots 29 through 34 of Arnold's First Addition. <br />b. In vacated alley south of Lots 1 through 5 or Arnold's First Addition <br />c. In vacated alley south of Lots 35-39 of Arnold's First Addition. <br />Therefore, upon a motion made by Mr. Littrell, seconded by Ms. Roemer and carried, the Release <br />of Easement was approved. <br />APPROVE CONSENT TO ANNEXATION AND WAIVER OF RIGHTS TO REMONSTRATE <br />Ms. Roemer stated that the Board is in receipt of a Consent to Annexation and Waiver of Right to <br />Remonstrate as submitted by Ms. Michelle Schmidt. The Consent indicates that in consideration for <br />permission to tap into the public sanitary sewer system of the City, to provide sanitary sewer service <br />to 19652 Paxson Drive, South Bend, Indiana, South Bend, Indiana, (Key # 02-1094-4543), Ms. <br />Schmidt's waives and releases any and all rights to remonstrate against or oppose any pending or <br />future annexation of the property by the City of South Bend. Therefore, Ms. Roemer made a motion <br />that the Consent be approved. Mr. Littrell seconded the motion which carried. <br />APPROVE TRAFFIC CONTROL DEVICE <br />Upon a motion made by Mr. Littrell, seconded by Ms. Roemer and carried, the following traffic <br />control device was approved: <br />
