APPROVAL OF PRESENTATION OF OBSOLETE CITY -OWNED PROPERTY In a letter to the Board, Police Chief Larry E. Bennett stated that Corporal Paul R. Deguch was in good standing with the South Bend Police Department effective August 24, 1997 when he was killed in the line of duty. In keeping with the spirit of Section 2-120 of the Municipal Code of the City of South Bend, Indiana, it was requested that the Board of Public Works declare his service weapon, a Sig Sauer .40 caliber handgun, (AD 19080 - the firing pin and magazine are not part of weapon as presented) as surplus property no longer useful to the City. The presentation of the above described property will be presented to Mrs. Deguch as a tribute for her husband's dedicated service to the City. Upon a motion made by Mr. Littrell, seconded by Ms. Roemer and carried, the request was approved. APPROVAL OF GRANT OF EASEMENT - MIAMI STREET SANITARY SEWER Upon a motion made by Mr. Littrell, seconded by Ms. Roemer and carried, a Grant of Easement for 6115 Miami Road was approved. This Grant of Easement is in conjunction with the Miami Road Sanitary Sewer project. APPROVAL OF RELEASE OF EASEMENT - MERRY AVENUE Mr. Carl Littrell, City Engineer, stated that Batteast Construction Company is in process of redeveloping land in Arnold's First Addition to the City of South Bend. Their property includes Lots 1 to 5, 29 to 34 and 35-39 of that subdivision, including the vacated street and alleys adjacent to those lots. There are not active sewer or water mains located in those vacated rights of way and there is no need to retain right of easement for utilities in those vacated rights of way. Batteast Construction Company requests that the rights of easement be released. Mr. Littrell recommended that the Board release all rights of easement for utilities in the following locations: a. In vacated Merry Avenue south of lots 29 through 34 of Arnold's First Addition. b. In vacated alley south of Lots 1 through 5 or Arnold's First Addition c. In vacated alley south of Lots 35-39 of Arnold's First Addition. Therefore, upon a motion made by Mr. Littrell, seconded by Ms. Roemer and carried, the Release of Easement was approved. APPROVE CONSENT TO ANNEXATION AND WAIVER OF RIGHTS TO REMONSTRATE Ms. Roemer stated that the Board is in receipt of a Consent to Annexation and Waiver of Right to Remonstrate as submitted by Ms. Michelle Schmidt. The Consent indicates that in consideration for permission to tap into the public sanitary sewer system of the City, to provide sanitary sewer service to 19652 Paxson Drive, South Bend, Indiana, South Bend, Indiana, (Key # 02-1094-4543), Ms. Schmidt's waives and releases any and all rights to remonstrate against or oppose any pending or future annexation of the property by the City of South Bend. Therefore, Ms. Roemer made a motion that the Consent be approved. Mr. Littrell seconded the motion which carried. APPROVE TRAFFIC CONTROL DEVICE Upon a motion made by Mr. Littrell, seconded by Ms. Roemer and carried, the following traffic control device was approved:
