REGULAR MEETING JUNE 24, 2002 <br />Office of the Recorder of St. Joseph County, Indiana. . <br />Section II. That it shall be and hereby is now declared and established that it is the policy of <br />the City of South Bend, by and through its Board of Public Works, to furnish to said territory services <br />of a non -capital nature, such as street and road maintenance, street sweeping, flushing, and snow <br />removal, within one (1) year of the effective date of the annexation in a manner equivalent in standard <br />and scope to services furnished by the City to other areas of the City regardless of similar topography, <br />patterns of land utilization, and population density; and to furnish to said territory, services of a capital <br />improvement nature such as a sanitary sewer system and a water distribution system, within four (4) <br />years of the effective date of the annexation in the same manner as those services are provided to <br />areas within the corporate boundaries of the City of South Bend regardless of similar topography, <br />patterns of land use, or population density. <br />Section III. That the Board of Public Works shall and does hereby now establish and adopt <br />the Fiscal Plan, attached hereto as Exhibit "A", and made a part hereof, for the furnishing of said <br />services to the territory to be annexed, specifically those provisions relating to Public Works at page <br />5 of the Fiscal Plan. These provide, among other things, that an existing municipal water main line <br />and the existing municipal sanitary sewer network are sufficient to service this area subject to all <br />connection fees and capital costs assessments imposed by law which shall be assumed and paid by the <br />owner. <br />Adopted the 20t' day of June 2002. <br />BOARD OF PUBLIC WORKS <br />OF THE CITY OF SOUTH BEND, INDIANA <br />s/Gary Gilot, President <br />s/Carl Littrell, Member <br />s/Donald E. Inks, Member <br />ADOPT RESOLUTION NO. 38-2002 - APPOINTING A NEGOTIATOR FOR THE 2002 <br />TEAMSTER NEGOTIATIONS <br />Upon a motion made by Mr. Gilot, seconded by Mr. Inks and carried, the following Resolution was <br />adopted by the Board of Public Works: <br />WHEREAS, the South Bend Board of Public Works acknowledges that Mr. Robert Warnock, <br />President of the Teamster Local Union No. 364, sent a letter dated March 19, 2002 to Mayor Stephen J. <br />Luecke giving official notice that Teamster Local Union No. 364 desires to negotiate changes and <br />modifications to the Agreement Between the City of South Bend and Teamsters Local Union No. 364 <br />("Agreement") which expires on December 31, 2002; and <br />WHEREAS, the South Bend Common Council, which is the body authorized to approve a <br />contract between the City and Teamster Local Union No. 364, is expected to adopt a resolution at its <br />meeting of June 24, 2002 appointing a negotiator for the purpose of reaching a new agreement with <br />Teamster Local Union No. 364 through the negotiating process, related to such items as working <br />conditions and other such items addressed in the Agreement; and <br />WHEREAS, the South Bend Common Council has the authority to approve wages and budgetary <br />items addressed in the Agreement; and <br />WHEREAS, the Board of Public Works hereby wishes to act in unity with the South Bend <br />Common Council for the purpose of reaching a new agreement with Teamster Local Union No. 364, <br />through the negotiating process, related to such items as annual compensation and other budgetary items <br />addressed in the Agreement; and <br />WHEREAS, the Board of Public Works, in agreement with the South Bend Common Council, <br />wishes to appoint a negotiator to address wages and other budgetary items addressed in the Agreement; <br />and <br />WHEREAS, the negotiator appointed by the Board of Public Works, together with any persons <br />named by the negotiator to act in an advisory capacity to the negotiator shall not be considered a <br />"Governing body" or "public agency" under either Indiana Code 5-14-1.5-2 or 5-14-3-1. <br />
