012 <br />REGULAR MEETING <br />EXCAVATION BOND <br />American Home Dreams <br />MAY 13, 2002 <br />Approved Effective May 13, 2002 <br />Mr. Gilot made a motion that the recommendation be accepted and that the Bond be approved as <br />outlined above. Mr. Inks seconded the motion which carried. <br />APPROVE CLAIMS <br />Mr. Gilot stated that the following claims were submitted to the Board for approval: <br />Name <br />Amount of Claim <br />Date <br />City of South Bend <br />$2,251,228.72 <br />May 13, 2002 <br />Mr. Gilot made a motion that the claims be approved and the reports as submitted be filed. Mr. Inks <br />seconded the motion which carried. <br />ADOPT RESOLUTION NO. 29-2002 - REMOVAL OF AMERITECH PHONE LINES <br />Upon a motion made by Mr. Gilot, seconded by Mr. Littrell and carried, the following Resolution <br />was adopted by the Board of Public Works: <br />RESOLUTION NO.29-2002 <br />WHEREAS, the Board of Public Works of the City of South Bend, through its Department <br />of Redevelopment, has embarked on a revitalization project at the intersection of Sample and Olive <br />Streets on the west side of South Bend; and <br />WHEREAS, of utmost importance to the success of the rest of the project is that construction <br />proceed as quickly as possible; and <br />WHEREAS, the removal of existing power lines in the area are a necessary step in the <br />proj ect. <br />NOW, THEREFORE, BE IT RESOLVED by the Board of Public Works of the City of South <br />Bend, Indiana, that it requests Ameritech to proceed at once with the removal of its power lines from <br />that area, that the City of South Bend will pay out of the County Option Income Tax funds, without <br />prejudice to any reimbursement to those funds from other sources, all charges associated with the <br />same up to the amount of $142,000.00 according to the terms and conditions of service authorized <br />by the Indiana Utility Regulatory Commission. The removal of the power lines is requested for the <br />convenience and benefit of the City of South Bend. <br />ADOPTED this 131h day of May 2002. <br />CITY OF SOUTH BEND <br />BOARD OF PUBLIC WORKS <br />s/Gary Gilot, President <br />s/Carl Littrell, Member <br />s/Don Inks, Member <br />ATTEST: <br />s/Angela K. Jacob, Clerk <br />APPROVAL OF DECLARATION OF RESTRICTION ON LAND USE <br />Mr. Gilot stated that Mr. Haji Tehrani, Drive & Shine Development, 5406 North Main Street, <br />Mishawaka, Indiana, submitted a Declaration of Restriction on Land Use, for the approximate <br />twenty-six (26) acre retention basin on Ironwood, to voluntarily create a wildlife habitat conservation <br />area and to restrict any discharge of fill, mowing, and removal of native vegetation in this area. The <br />proper permits have been obtained from the Indiana Department of Environmental Management. <br />Upon a motion made by Mr. Inks, seconded by Mr. Littrell and carried, the Declaration of Restriction <br />on Land Use was approved. <br />1 <br />
