REGULAR MEETING APRIL 8, 2002 <br />upon a motion made by Mr. Littrell, seconded by Mr. Gilot and carried, the request for residential <br />parking was denied. <br />TABLE PETITION FOR RESERVED PARKING AREA - 211 SOUTH MICHIGAN <br />Ms. Karen Brandy -Comer, 211 South Michigan, Apartment 302 (Robertson's Apartments) submitted <br />a Petition for Reserved Parking at the above referred to address. Ms. Marcia Qualls, Customer <br />Service Coordinator, stated that Ms. Brandy -Comer is a resident of Robertson's Apartments, and the <br />Petition for Reserved Parking Area is designated for employees, according to Municipal Code. The <br />Board does not have jurisdiction to make a decision in this matter at this time. The Board asked Ms. <br />Qualls to review this Ordinance with the City Council. Upon a motion made by Mr. Gilot, seconded <br />by Mr. Inks and carried, the Petition was tabled. <br />APPROVAL OF AUTHORIZATION FOR ENTRY UPON PUBLIC PROPERTY FOR HOME <br />CONSTRUCTION - ROLAND COURT - AMERICAN HOME DREAMS <br />An Authorization for Entry Upon Public Property for Home Construction was submitted to the Board <br />for approval. The authorization allows American Home Dreams to enter upon the properties listed <br />in the document as submitted (Roland Court) for the purpose of constructing homes in the Sample - <br />Ewing development area. Upon a motion made by Mr. Inks, seconded by Mr. Littrell and carried, <br />the Authorization was approved. <br />APPROVE CONSENT TO ANNEXATION AND WAIVER OF RIGHTS TO REMONSTRATE <br />Mr. Gilot stated that the Board is in receipt of a Consent to Annexation and Waiver of Right to <br />Remonstrate as submitted by Mr. Andrew Place, Place Builders, 2133 Foxboro, Mishawaka, Indiana. <br />The Consent indicates that in consideration for permission to tap into the public sanitary sewer <br />system of the City, to provide sanitary sewer service to Lot A Bean Minor Subdivision, South Bend, <br />Indiana, (Key # 01-1017-0340.09), Place Builders waive and release any and all right to remonstrate <br />against or oppose any pending or future annexation of the property by the City of South Bend. <br />Therefore, Mr. Gilot made a motion that the Consent be approved. Mr. Littrell seconded the motion <br />which carried. <br />APPROVAL OF RELEASE OF UTILITY EASEMENT RIGHTS - VACATED DUNHAM <br />STREET AND ADJACENT VACATED ALLEYS - WEST SIDE OF CHAPIN <br />Mr. Jason Durr, Engineering, requested permission to release utility easement rights within a <br />previously vacated Dunham Street and adjacent vacated alleys within the Plat of Dunham's <br />Subdivision of the north part of Bank Outlet #78 located on the west side of Chapin Street, <br />approximately 650 feet north of Sample Street. The site is the present location of an existing truck <br />facility which lies south of the Oliver Plow Works property. Upon a motion made by Mr. Gilot, <br />seconded by Mr. Inks and carried, the Release of Utility Easements was approved. <br />APPROVAL OF RELEASE OF EASEMENT RIGHTS - GRANT STREET AND SCHULMAN <br />DRIVE <br />Mr. Jason Durr, Engineering, requested permission to release utility easements within the proposed <br />vacated Grant Street and Schulman Drive bounded by Sample Street on the north, Olive Street on <br />the east and the Indiana Northern Railroad on the south, to allow for a new distribution center to be <br />located on the several parcels that lie on either side of the two named streets. Upon a motion made <br />by Mr. Gilot, seconded by Mr. Littrell and carried, the Release of Utility Easements was approved. <br />APPROVAL OF GRANTS OF EASEMENT - LINDEN AVENUE STREET LIGHTING <br />Mr. Chris Dressel, Economic Development, submitted Grants of Easements for 220 North Olive and <br />234 Carlisle for the installation and maintenance of street lighting and accompanying underground <br />lighting circuits. Upon a motion made by Mr. Gilot, seconded by Mr. Littrell and carried, the Grants <br />of Easement were approved. <br />APPROVE AND/OR RELEASE CONTRACTOR AND EXCAVATION BONDS <br />Mr. Anthony Molnar, Engineer, Division of Engineering, recommended that the following <br />Contractors and Excavation Bonds be approved and/or released as follows: <br />BOND OF CONTRACTOR <br />Brooks Construction Released Effective April 4, 2002 <br />
