<br />REGULAR MEETING FEBRUARY 25, 2002
<br />The regular meeting of the Board of Public Works was convened at 9:35 a.m. on Monday, February
<br />25, 2002, by Board Member Carl P. Littrell, with Mr. Donald E. Inks present. Board President Gary
<br />Gilot was not present. Also present was Board Attorney Thomas Bodnar.
<br />APPROVE MINUTES OF PREVIOUS MEETING
<br />Upon a motion made by Mr. Littrell, seconded by Mr. Inks and carried, the minutes of the regular
<br />meeting of the Board held on February 11, 2002, were approved.
<br />AGENDA ITEMS ADDED
<br />Upon a motion made by Mr. Littrell, seconded by Mr. Inks and carried, the following items were
<br />added to the agenda:
<br />- Contractor/Excavation Bonds
<br />- Request to Reject Bids/Re-Advertise for the Receipt of Bids - 2001 Sewer Lining Program
<br />PUBLIC HEARING - LICENSE APPLICATION FOR TRANSIENT MERCHANTS -
<br />COMPUTER TRADE SHOW AND SALE
<br />Mr. Gilot advised that this was the date set for the Board's Public Hearing concerning a License
<br />Application for Transient Merchant, as submitted by Ms. Jeanette Winton, 7004 Armat, Bethesda,
<br />Maryland, to conduct the sale of computers and accessories on March 2-3, April 27, May 25, June
<br />23, July 21, August 17, September 14, and November 2-3, 2002 at the Century Center in South
<br />Bend, Indiana. It was noted that favorable recommendations were received from the Police
<br />Department, Fire Department, Building Department and the Legal Department.
<br />Ms. Julie Nowack, Century Center, was present, and recommended approval. There being no one
<br />else present wishing to address the Board concerning this matter, the Public Hearing was closed.
<br />Therefore, upon a motion made by Mr. Littrell, seconded by Mr. Inks and carried, the License
<br />Application was approved.
<br />PUBLIC HEARING - REOUEST FOR DE -ANNEXATION OF PARCEL OF LAND ON THE
<br />NORTH SIDE OF SOUTH BEND NEAR CLEVELAND ROAD
<br />Mr. Gilot advised that this was the date set for the Board's Public Hearing concerning a request for
<br />de -annexation of a parcel of land on the north side of South Bend, as submitted in the legal
<br />description, by Mark and Debra Weaver, 20090 Brookwood Drive, South Bend, Indiana. It was
<br />noted that Mark and Debra Weaver submitted a petition to the Board of Public Works for de -
<br />annexation of the parcel of land. They stated that the parcel is not being serviced by any City of
<br />South Bend utilities.
<br />Ms. Aladean DeRose, Legal Department, was present, and stated that this de -annexation has unusual
<br />and unique circumstances. This parcel of land consists of 10.49 acres, and is the only residential
<br />property in an area within two (2) miles from any incorporated part of the City of South Bend. Water
<br />and sewer utilities are located more than 2,000 feet, and cost to connect to these services is cost
<br />prohibited to the City of South Bend. Extending the utilities to this site would be cost prohibitive
<br />and would not be practical. The Findings of Fact (twelve issues) were presented to the Board, which
<br />were found to be accurate and true, and were verified by Mr. Larry Magliozzi, Planning Department.
<br />Based on these findings, Ms. DeRose and Mr. Magliozzi recommended approval of the request for
<br />de -annexation.
<br />There being no one else present wishing to address the Board concerning this matter, the Public
<br />Hearing was closed.
<br />Therefore, upon a motion made by Mr. Inks, seconded by Mr. Littrell and carried, the request for de -
<br />annexation was approved.
<br />OPENING OF BIDS - GOOD NEIGHBORS/GOOD NEIGHBORHOODS CURB AND
<br />SIDEWALK IMPROVEMENTS - PROJECT NO. 102-019
<br />This was the date set for receiving and opening of sealed bids for the above referred to project. The
<br />Clerk tendered proofs of publication of Notice in the South Bend Tribune and the Tri-County News
<br />which were found to be sufficient. The following bids were opened and publicly read:
