021 <br />REGULAR MEETING <br />JANUARY 28, 2002 <br />Section I. That it is in the best interest of the City of South Bend and the area proposed to <br />be annexed that the real property located in German Township, St. Joseph County, Indiana, described <br />more particularly at Table I, page 11 of Exhibit "A" (the fiscal plan) attached hereto and made a part <br />hereof, be annexed to the City of South Bend. <br />Section II. That it shall be and hereby is now declared and established that it is the policy <br />of the City of South Bend, by and through its Board of Public Works, to furnish to said territory <br />services of a non -capital nature, such as street and road maintenance, street sweeping, flushing, snow <br />removal, within one (1) year of the effective date of the annexation in a manner equivalent in <br />standard and scope to services furnished by the City to other areas of the City regardless of similar <br />topography, patterns of land utilization, and population density; and to furnish to said territory, <br />services of a capital improvement nature such as a sanitary sewer system, a water distribution <br />system, street and road construction, and a street lighting system within four (4) years of the effective <br />date of the annexation in the same manner as those services are provided to areas within the <br />corporate boundaries of the City of South Bend regardless of similar topography, patterns of land <br />use, or population density. <br />Section III. That the Board of Public Works shall and does hereby now establish and adopt <br />the fiscal plan, attached hereto as Exhibit "A", and made a part hereof, for the furnishing of said <br />services to the territory to be annexed, which provides in relevant part that existing water and sewer <br />mains are sufficient to service this area, that the Motor Vehicle Highway Fund and Local Road and <br />Street Fund will provide sufficient revenue to pay for street maintenance, sweeping and snow <br />removal and, that the City of South Bend will bear the expense of electricity for a street lighting <br />system from the General Fund, all as set more specifically at page 5 and 7 of Exhibit "A". <br />Adopted the 23rd day of January 2002. <br />BOARD OF PUBLIC WORKS <br />OF THE CITY OF SOUTH BEND, INDIANA <br />s/Gary Gilot, President <br />s/Donald E. Inks, Member <br />APPROVAL OF AUTHORIZATION FOR ENTRY UPON PUBLIC PROPERTY FOR DRILLING <br />PURPOSES <br />Mr. Gilot stated that the Board is in receipt of an Authorization For Entry Upon Public Property for <br />Drilling Purposes submitted by Mr. Alan Schmidt, RMT, Inc., 222 South Riverside Plaza, Suite 820, <br />Chicago, Illinois. The document requests access to property along the 2000 block of West <br />Washington Street, West Orange (between Huey and Grant Streets), and O'Brien Street (between <br />Orange and West Washington Streets), South Bend, Indiana, for the purpose of drilling holes and <br />test wells. This permission will be needed until February 15, 2002. Therefore, Mr. Gilot made a <br />motion that the request be approved. Mr. Inks seconded the motion which carried. <br />APPROVE CONSENT TO ANNEXATION AND WAIVER OF RIGHTS TO REMONSTRATE <br />Mr. Gilot stated that the Board is in receipt of a Consent to Annexation and Waiver of Right to <br />Remonstrate as submitted by Ferdinand J. and Sandra J. Krizmanich. The Consent indicates that in <br />consideration for permission to tap into the public sanitary sewer system of the City, to provide <br />sanitary sewer service to 18000 Bariger Place, South Bend, Indiana, (Key #02-1171-8158), the <br />Krizmanichs' waive and release any and all right to remonstrate against or oppose any pending or <br />future annexation of the property by the City of South Bend. Therefore, Mr. Gilot made a motion <br />that the Consent be approved. Mr. Inks seconded the motion which carried. <br />APPROVE AND/OR RELEASE CONTRACTOR AND EXCAVATION BONDS <br />Mr. Anthony Molnar, Engineer, Division of Engineering, recommended that the following <br />Contractors and Excavation Bonds be approved and/or released as follows: <br />BOND OF CONTRACTOR <br />LaMar Colley dba Colley Concrete Released effective January 23, 2002 <br />Ziolkowski Construction, Inc. Approved January 23, 2002 <br />
