That the Board of Public Works shall and does hereby now establish <br />and adopt the Fiscal Plan, attached hereto as Exhibit "A", and made a part hereof, for the <br />furnishing of said services to the territory to be annexed, which provides, among other <br />things, that existing water mains and sewer main lines will be sufficient to service this <br />area with the developer paying for the extension of an existing sewer main line; that the <br />developer will install necessary street lighting at its expense; that the developer will <br />construct and pay for any new public streets necessary to access the development area; <br />and that a street drainage plan will be planned, provided and paid for by the developer <br />subject to compliance with state and local law. <br />Adopted the 22" d day of August 2005. <br />BOARD OF PUBLIC WORKS <br />OF THE CITY OF SOUTH BEND, INDIANA <br />s/Gary Gilot, President <br />s/Carl Littrell, Member <br />APPROVE CONSENT TO ANNEXATION AND WAIVER OF RIGHTS TO <br />REMONSTRATE <br />Mr. Gilot stated that the Board is in receipt of a Consent to Annexation and Waiver of <br />Right to Remonstrate as submitted by Mr. and Mrs. John Koellner. The Consent <br />indicates that in consideration for permission to tap into public sanitary water system of <br />the City, to provide sanitary water service to the southeast corner of State Road 23 and <br />Crestwood Boulevard, South Bend, Indiana, (Key #02-2023-0544.09 Lot 3 and pt Lot 2), <br />the Koellner's waive and release any and all right to remonstrate against or oppose any <br />pending or future annexation of the property by the City of South Bend. Therefore, Mr. <br />Gilot made a motion that the Consent be approved. Mr. Littrell seconded the motion, <br />which carried. <br />TABLE CONSENT TO ANNEXATION AND WAIVER OF RIGHTS TO <br />REMONSTRATE — SOUTH BEND COUNTRY CLUB <br />Mr. Gilot made a motion that the Consent be tabled, pending a legal description. Mr. <br />Littrell seconded the motion, which carried. <br />APPROVE TRAFFIC CONTROL DEVICES <br />Upon a motion made by Mr. Gilot, seconded by Mr. Littrell and carried, the following <br />traffic control devices were approved: <br />NEW INSTALLATION: Handicapped Accessible Parking Space Signs <br />LOCATION: 2530 West Linden <br />REMARKS: All Criteria has been met <br />NEW INSTALLATION: Handicapped Accessible Parking Space Signs <br />LOCATION: 114 Meade Street <br />REMARKS: All Criteria has been met <br />FILING OF CERTIFICATE OF INSURANCE <br />Upon a motion made by Mr. Gilot, seconded by Mr. Littrell, and carried, the following <br />Certificate of Insurance was accepted for filing: <br />National Football Foundation, <br />College Football Hall of Fame <br />Morristown, New Jersey <br />APPROVE TITLE SHEET — STUDEBAKER MUSEUM ARCHIVE BUILDING <br />IN( DOT) <br />Mr. Gilot advised that the Title Sheet for the above referred to project was being <br />presented at this time for execution. Upon a motion made by Mr. Gilot, seconded by Mr. <br />Littrell and carried, the above referred to Title Sheet was approved and signed. <br />
