Upon a motion made by Mr. Gilot, <br />seconded by Mr. Littrell and carried, the request was approved. <br />APPROVAL OF RECOMMENDATION ONTO ENCROACH ONTO PUBLIC RIGHT- <br />OF-WAY — INSTALLATION OF HANDICAP RAMP — 2801 SOUTH MICHIGAN - <br />THE LANDIN <br />Mr. Gilot advised that the Board is in receipt of favorable recommendations from the <br />Division of Engineering, Police Department, Building Commissioner and the Fire <br />Department for the installation of a. handicap ramp at 2801 South Michigan. Upon a <br />motion made by Mr. Littrell, seconded by Mr. Inks, and carried, the recommendation was <br />approved. <br />FAVORABLE RECOMMENDATION - PETITION TO VACATE PROPERTY <br />RIGHT-OF-WAY BEGINNING AT THE SOUTHEAST CORNER OF LOT 166 OF <br />UNIVERSITY HEIGHTS. A SUBDIVISION IN THE CITY OF SOUTH BEND <br />Mr. Gilot indicated that Mr. Douglas Marsh, University of Notre Dame, Notre Dame, <br />Indiana, has submitted a request to vacate the above referred to property. Mr. Gilot <br />advised that the Board is in receipt of favorable recommendations concerning this <br />Vacation Petition from the Area Plan Commission, Police Department, Fire Department, <br />Sanitation, Department of Economic Development and the Department of Public Works. <br />Therefore, Mr. Littrell made a motion that the Clerk send a letter to the petitioner <br />addressing these concerns. Mr. Inks seconded the motion which carried. <br />ADOPT RESOLUTION NO. 33-2005 - DECLARING THE OFFICIAL INTENT OF <br />SUCH BOARD AND THE CITY TO REIMBURSE EXPENDITURES RELATING TO <br />CERTAIN ADDITIONS, EXTENSIONS AND IMPROVEMENTS FOR THE CITY'S <br />MUNICIPAL WATERWORKS, WITH THE PROCEEDS OF BONDS TO BE ISSUED <br />BY THE CITY <br />Upon a motion made by Mr. Gilot, seconded by Mr. Littrell and carried, the following <br />Resolution was adopted by the Board of Public Works: <br />WHEREAS, the City of South Bend, Indiana (the "City") has heretofore established, <br />constructed and financed a municipal waterworks (the "Waterworks") and now owns and <br />operates the Waterworks, by and through its Board of Public Works (the "Board"), <br />pursuant to I.C. 8-1.5, as amended, and other applicable laws (together, the "Act"). <br />1 <br />1 <br />
