WHEREAS, the Common Council of the City of South Bend, Indiana, has adopted a Declaratory Resolution designating certain areas within the City as Economic Revitalization Areas for the purpose of tax abatement consideration; and WHEREAS, a Declaratory Resolution designated the area commonly known as 3722 Foundation Court, South Bend, Indiana, and which is more particularly described as follows: and which has Key Number 025-1010-040018, as an Economic Revitalization Area; and WHEREAS, notice of the adoption of a Declaratory Resolution and the public hearing before the Council has been published pursuant to Indiana Code 6-1.1-12.1-2.5; and WHEREAS, the Council held a public hearing for the purposes of hearing all remonstrance's and objections from interested persons; and WHEREAS, the Council has determined that the qualifications for an economic revitalization area have been met. NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of South Bend, Indiana, as follows: SECTION I. The Common Council hereby confirms its Declaratory Resolution designating the area described herein as an Economic Revitalization Area for the purposes of tax abatement. Such designation is for Personal property tax abatement only and is limited to two (2) calendar years from the date of adoption of the Declaratory Resolution by the Common Council. SECTION II. The Common Council hereby determines that the property owner is qualified for and is granted Personal property tax deduction for a period of (5) five years, and further determines that the petition, the Memorandum of Agreement between the Petitioner and the City of South Bend, and the Statement of Benefits comply with Chapter 2, Article 6, of the Municipal Code of the City of South Bend and Indiana Code 6-1.1-12 et seq. SECTION V. The petitioner, Imagineering Enterprises, Inc. proposes to buy a 59,000 square foot building and to install $3.5 million of new equipment. DATE: August 1, 2007 On July 27, 2007, a petition for personal property tax abatement consideration for property located at 3722 Foundation Court Drive, South Bend was filed with the City Clerk by Imagineering Enterprises, Inc. Pursuant to Chapter 2, Article 6, Section 2-82 of the Municipal Code of the City of South Bend, this petition was referred to the Department of Community and Economic Development for purposes of investigation and preparation of a report determining whether the area qualifies as an Economic Revitalization Area pursuant to I.C.6-1.1-12.1 and whether all zoning requirements have been met. The Department of Community and Economic Development has reviewed the petition, investigated the area, and makes the following report. PROJECT SUMMARY Imagineering Enterprises, Inc. intends to acquire a vacant 59,000 square foot building at 3722 Foundation Court, South Bend, IN. The acquired building will be the processing facility and office of their operation in South Bend. The estimated total cost of the project is $5.1 million with new equipment being installed at a cost of $3.5 million. The processing facility will provide electroless nickel plating, phosphate coatings, passivation processes, non destruction testing and quality assurance testing for client's components as the final step in the manufacturing process. The new equipment for the manufacturing process will include lab equipment, wet processing and phosphate passivation equipment, paint line, NDT equipment, and waste treatment equipment. South Bend Common Council RE: Tax Abatement for Imagineering Enterprises, Inc. August 1, 2007 Page 2 Total taxes to be abated during the five year abatement are $213,238. Total taxes to be paid during the five year abatement are estimated to be $110,964. EMPLOYMENT IMPACT Per the petition, it is estimated that the total project will create six (6), new, permanent, full-time jobs over the next year with an estimated new annual payroll of $190,000. The project will also maintain sixty- nine (69) existing, permanent, full-time jobs and two (2) existing, permanent, part- timejob representing an annual payroll of $2,687,738. ABATEMENT QUALIFICATION 1. A review of the tax abatements previously granted finds that the petitioner has been granted or associated with (3) three previous tax abatements: Term/Type Resolution No. Date S-year personal property 2468-97 6/23/97 10-year real property 3240-03 9/8/03 10 year real property 3545-OS 12/12/05 2. The Building Commissioner has reviewed the petition and finds the property to be properly zoned for the proposed project. A review of the South Bend Redevelopment designation areas finds that the property is located in the Airport Economic Development Area, which is a Tax Incremental Allocation Area; therefore, the petition for real property tax abatement must first be approved by the South Bend Redevelopment Commission. 4. A review of the Tax Abatement Ordinance No. 9394-03 finds that the petitioner does meet the qualifications fora (5) five-year personal property tax abatement. CONSIDERATION The uadersigned owner{s) of new .manufacturing equipment, personal property, located within the City of South Bend, hereby petitions the Common Council of the City of South Bend for personal property (new manufacturing equipment) tax abatement consideration and pursuant to I.C., 6-1.1-12.1, et se .and South Bend Municipal. Code Section 2-$4.2, et seQ•, for this petition states the following: 1. Describe the proposed project, including information about the new manufacturing equipment personal property {Aequipment@) to be installed, the amount of land to be used, if any, the proposed use of the equipment, and a general statement as to the value of the project to your business. Acquisition of a 59 000 sg. ft. building and purchase of new equipment to be erected at 3722 Foundation Ct. South Bend, IN. St Joseph County. The estimated cost of the project is 5.1 million.
