DEROSE <br />CITYATTORNEY CHIEF ASSISTANT CITYATTORNEY <br />October 7, 2009 <br />Mr. Derek Dieter <br />President, South Bend Common Council ~ L ~ ~ ~~~ . ~ ~ __~1; ~_ <br />4't' Floor, County-City Building <br />South Bend, IN 46601 <br />Re: Ordinance Amending Sewage Works Bond Ordinance #9951-09 <br />Dear President Dieter: <br />Attached for filing with the South Bend Common Council is an ordinance amending <br />Ordinance #9951-09 which was recently passed and which authorized improvements and <br />extensions of the City's Sewage Works through issuance and sale of revenue bonds. <br />Because of the City's duty to place a portion of the approved bond proceed funds in a <br />separate debt reserve account, the Sewage Works could not perform the project as fully <br />contemplated. To remedy this, the State Revolving Fund Loan Program (SRF) is making <br />available additional funds in the sum of $1,500,000.00. The attached ordinance amends Section <br />II of Ordinance 9951-09 to expand the project description now made possible by infusion of <br />these additional funds, specifically, improvements to Kennedy Park.
