~~ ,„ EXECUTIVE SESSION JULY 31, 2006 The 13oard of Public Safety met in Executive Session on Monday, July 31, 2006, at 9:50 a.m. The meeting was held in the Mayor's Conference Room, 14t"Floor, County City Building, South Bend, Indivza, for the purposes specified in LC. 5-14-1.5-6.1 (b) (2) (B) and (b) (6) (A). President Jesusa Rodriguez and Board Members, Donald Alford, and Patrick Cottrell were present. Board Members Juanita Dempsey and Bruce J. BonDurant were not present. Also present during the session were Police Chief Thomas H. Fautz and Assistant City Attorney Cheryl Greene and Deputy City Attorney John Broden. Board Attorney Thomas Bodnar and Fire Chief Luther Taylor were not present. Board members did not discuss any subject matter other than the subject matter as specified in the Public Notice. Cottrell, Member ATTEST: Angela K. ~ ob, Clerk SPECIAL MEETING JULY 31, 2006 The Board of Public Safety met in a special meeting at 10:04 a.m. on Monday, July 31, 2006, with President Jesusa Rodriguez acid Board Members Donald Alford, and Patrick D. Cottrell present. Board Members Juanita Dempsey and Bruce J. BonDurant were not present. Also present were Fire Police Chief Thomas H. Fautz and Deputy City Attorney John Broden. Board Attorney Thomas Bodnar and Fire Chief Luther Taylor were not present. The meeting was held in the Board of Public Building, South Bend, Indiana. POLICE DEPARTMENT Works Meeting Room, 13`" Floor, County-City APPROVE REQUEST FOR ADMINISTRATIVE LEAVE OF ABSENCE -TONY MACIK President Rodriguez stated that the Board is in receipt of correspondence from Police Chief Fautz stab ng that on July 27, 2006, Corporal Tony Macik was charged with Intimidation (Class D, Felony), Battery Resulting in Bodily Injury (Class A, Misdemeanor),•Trespass (Class A, Misdemeanor), Criminal Mischief (Class B, Misdemeanor) and Disorderly Conduct (Class B, Misdemeanor) in Elkhart Superior Court #6, Cause #20D06-0607-FD-262. Chief Fautz requests the Board, pursuant to IC 36-8-3-4(n), place Corporal Macik on Administrative Leave without pay until the disposition o f the criminal charges in the trial court. There being no further discussion, a motion was made by Mr. Cottrell, to approve the above request effective today. It was seconded by Mr. Alford and carried. 1 1
